Proof of SMS opt-in: Chopscape

Chopscape sends two kinds of text message, and each kind has its own consent. Both are set out below with screenshots of the live website and the exact wording a customer reads before agreeing. Every page linked here is public and needs no login.

1. MARKETING texts: the customer ticks a box

Where: https://www.chopscape.com/text-alerts/

Screenshot of the Chopscape text alerts page showing an empty, unticked SMS consent checkbox with the consent wording printed beneath it
Screenshot of https://www.chopscape.com/text-alerts/ as a customer first sees it.

What the picture shows:

  • A tick box that is empty by default. Nothing is pre-ticked.
  • No phone field is shown at all until the box is ticked, so a mobile number cannot be submitted without consent being given first.
  • The full consent wording is printed directly underneath the box, on the same screen, before the customer acts.
  • The marketing text box and the email box are separate boxes, and neither is tied to a booking.

The exact wording on and under that box:

Text me exclusive deals and offer alerts from Chopscape.

Recurring marketing texts, approx 2-4/month. Msg & data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out, HELP for help.

This box is for marketing texts only. By ticking it you agree to receive recurring automated marketing text messages from Chopscape at the number you provide. It does not cover booking or account texts, which are handled separately when you book. Consent is not a condition of any purchase. Approx 2-4 msgs/month. Msg & data rates may apply. Reply STOP to opt out, HELP for help. See our Privacy Policy and Terms & Conditions.

The same page after the customer ticks the box. Only then do the mobile number field and the Save button appear.

2. MARKETING texts: the customer texts a keyword

A customer can also join by texting CHOPS to (760) 437-1642, which is the same number the programme sends from. The programme description, the message frequency, the STOP and HELP instructions and the “consent is not a condition of purchase” wording are all printed next to the keyword on https://www.chopscape.com/text-alerts/.

The customer receives one reply confirming the subscription:

You’re in! Chopscape deals and last-minute openings, about 2-4 msgs/month. Msg&data rates may apply. Reply STOP to opt out, HELP for help.

HELP or INFO returns:

Reply STOP to unsubscribe. Msg&Data Rates May Apply.

STOP, CANCEL, QUIT, UNSUBSCRIBE, END, OPTOUT, STOPALL or REVOKE returns:

You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.

3. NON-MARKETING texts: booking and account messages the customer asks for

These go only to a customer who has given us their own mobile number and has asked us to text them something about their own booking, either on a call to our booking line or in the website chat. The assistant asks for permission in that call or chat before anything is sent, and the request is recorded against the booking.

  • What they contain: booking confirmations and changes, appointment reminders, one-time sign-in codes for https://www.chopscape.com/manage-booking/, price quotes, and booking or payment links the customer asked for.
  • They are never marketing, and they never advertise anything the customer did not ask about.
  • Frequency follows the customer’s own bookings. Reply HELP for help, STOP to opt out.
  • A number given this way is never added to the marketing text list.

4. The two lists never mix

  • Asking us to text a booking or payment link does not add the number to the marketing list.
  • Ticking the marketing box does not send booking or account messages.
  • STOP stops all messages of both kinds from this number.
  • The booking form shows a separate box reading “Do you want to join our mailing list?”. That box is an email consent, not a text consent, and no marketing text message is ever sent to a number given on the booking form.
