Privacy Policy

This policy explains how Chopscape LLC (“Chopscape”, “we”, “us”), 1906 Oceanside Blvd, Ste UV, Oceanside, California 92054, handles personal information collected through www.chopscape.com and at our venue.

Chopscape LLC is a separate and independent legal entity from Jardine Entertainment LLC (d/b/a RageScape), which operates other attractions at the same street address. This policy covers Chopscape only.

1. Notice at collection

Under the California Consumer Privacy Act as amended by the CPRA, here is what we collect, why, and how long we keep it.

We do not collect your Social Security number, financial account numbers, or precise geolocation. Card payments are processed by our booking provider — we never see or store your card number.

2. The ID scan — read this part

Before signing a waiver you may be asked to scan the barcode on the back of a US driver’s licence or state ID. We want to be precise about what that does, because it sounds more invasive than it is.

• The scan happens in your own browser, on your own phone. No image of your document is captured, uploaded, or stored — anywhere.
• We read exactly five fields: family name, first name, date of birth, expiry date, and issuing jurisdiction. The remainder of the barcode is discarded the moment your age is confirmed.
• We never read your licence or ID number, your address, or your physical description (height, weight, eye colour).

California Civil Code § 1798.90.1 permits a business to scan a driver’s licence or identification card solely to verify age or the authenticity of the document, and prohibits retaining or using that information for any other purpose. We do not use it for any other purpose, and we do not share it.

Date of birth is sensitive personal information under the CPRA. We use it only for age verification and for the waiver record. We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.

3. Cookies, analytics and advertising

We use Google Analytics 4 to understand how people find and use the site, and Google Ads to measure whether our advertising works. These set cookies on your device and may share limited information with Google.

We do not sell your personal information for money. However, using advertising cookies may count as “sharing” personal information for cross-context behavioural advertising under California law. You can switch this off:

• Use the Do Not Sell or Share My Personal Information control, available here and in the footer of every page.
• Or enable a Global Privacy Control signal in your browser.

Opting out is stored on your device, applies to future visits from that device, and does not affect your ability to book.

3a. Aggregate analysis

We look at waiver information in aggregate to run the business better — for example the overall age spread of our guests, which days and hours are busiest, and which activities are booked together. This helps us schedule staff, decide opening hours, and avoid advertising to the wrong people.

This analysis is aggregate only. It produces counts and averages, never individual profiles, and any group too small to be anonymous is suppressed rather than displayed. We do not use it to market to you individually, and we do not use driver’s licence scan data for it at all — that information is used solely for age and document verification, as California Civil Code § 1798.90.1 requires.

4. How long we keep waivers

Signed waivers are retained for a minimum of 13 years, and longer where a minor is involved. This is not us being acquisitive. California’s personal-injury limitation period is tolled for minors until they turn 18, so a waiver signed by a parent for a young child may need to survive well over a decade before a claim window even opens. Waivers are never deleted on request, because they are the record of an agreement you entered into.

5. Who we share information with

We do not sell personal information to data brokers.

6. Your California rights

• Know what we collect, use and disclose about you
• Delete personal information, subject to the waiver retention above and other legal exceptions
• Correct inaccurate personal information
• Opt out of sale or sharing for cross-context behavioural advertising
• Limit the use of sensitive personal information
• Not be discriminated against for exercising any of these rights — the price you pay and the service you get will not change

To make a request, email info@chopscape.com with “Privacy request” in the subject. We will verify your identity using information we already hold and respond within 45 days. You may use an authorised agent.

7. Children

Minimum age to throw is 13. Anyone under 18 must have a parent or legal guardian present who signs on their behalf. We do not knowingly collect information online directly from children under 13. Information about a minor reaches us through the parent or guardian who signs their waiver.

8. Security

Signed waiver records are stored in a protected location that is not publicly reachable, and an offsite copy is emailed to an account we control. The site is served over HTTPS. No system is perfectly secure, but we do not keep the categories of data — card numbers, licence numbers — that would make a breach severe.

9. Changes

If we change this policy we will update the date at the top. Material changes will be flagged on the site.
